TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS:
On or about May 17, 2024, the above named Town will request the
Mississippi Development Authority to release funds under Title I of the
Housing and Community Development Act of 1974, as amended, for the
following project: 2023 Community Development Block Grant Project which
consists of rehab of two lift stations, the replacement of a lift
station and equatic vegetation removal in the sewer lagoon($596,590.25).
The activities proposed are categorically excluded under HUD regulations
at 24 CFR Part 58 from National Environmental Policy Act (NEPA)
requirements. An Environmental Review Record (ERR) that documents the
environmental determinations for this project is on file at: Town of
Bude, 125 Railroad Ave, Bude, MS 39630 and may be examined and copied
between the hours of 8:00 A.M. and 4:00 P.M.
Finding of No Significant Impact
The Town of Bude has determined that the project will have no
significant impact on the human environment. Therefore, an
Environmental Impact Statement under the National Environmental Policy
Act of 1969 (NEPA) is not required. Additional project information is
contained in the Environmental Review Record (ERR) on file at: Town of
Bude, 125 Railroad Ave, Bude, MS 39630 and may be examined and copied
between the hours of 8:00 A.M. and 4:00 P.M.
Public Comments
All interested agencies, groups and persons may submit written comments
on the ERR to the Town of Bude. All comments received by May 17, 2024
will be considered by the Town of Bude prior to submission of a request
for release of funds.
Release of Funds
The Town of Bude certifies to the Mississippi Development Authority that
Linda Green in her capacity as Mayor of the Town of Bude consents to
accept the jurisdiction of the Federal Courts if an action is brought to
enforce responsibilities in relation to the environmental review process
and that these responsibilities have been satisfied. The Mississippi
Development Authority's approval of the certification satisfies its
responsibilities under NEPA and related laws and authorities and allows
the Town of Bude to use HUD program funds.
OBJECTIONS TO STATE RELEASE OF FUNDS
The Mississippi Development Authority will accept any objections to its
release of fund and the Town of Bude's certification for a period of
fifteen days following the anticipated submission date or its actual
receipt of the request (whichever is later) only if they are on one of
the following bases: (a) the certification was not executed by the
Certifying Officer of the Town of Bude; (b) the Town of Bude has omitted
a step or failed to make a decision or finding required by HUD
regulations at 24 CFR part 58; (c) the grant recipient or other
participants in the development process have committed funds, incurred
costs or undertaken activities not authorized by 24 CFR part 58 before
approval of a release of funds by the Mississippi Development Authority;
or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has
submitted a written finding that the project is unsatisfactory from the
standpoint of environmental quality. Objections must be prepared and
submitted in accordance with the required procedures (24 CFR Part 58,
Sec. 58.76) and shall be addressed to Attention: Steve Hardin at the
Mississippi Development Authority, Community Services Division, P.O. Box
849, Jackson, MS, 39205-0849. Potential objectors should contact the
Mississippi Development Authority to verify the actual last day of the
objection period.

IN THE 100-YEAR FLOODPLAIN AND WETLAND
To: All interested Agencies, Groups and Individuals
This is to give notice that the Town of Bude has conducted an evaluation
as required by Executive Orders 11988 and 11990 in accordance with HUD
regulations at 24 CFR 55.20 to determine the potential affect that its
activity in the floodplain and wetland will have on the environment.
The proposed project consists of the following: The rehab of two lift
stations, the replacement of a lift station and equatic vegetation
removal in the sewer lagoon. A portion of the proposed project may
impact less than one hundred (100) acres.
The Town of Bude has determined that it has no practicable alternative
other than locating the proposed Community Development Block Grant
project in a floodplain/wetland. This activity will have no significant
impact on the environment for the following reasons: A portion of the
proposed project is located in a floodplain/wetland, but there is not a
practicable alternative to this location because the project involves
repair/replacement of existing sewer lines. Every action will be taken
to minimize impacts to the floodplain/wetland. Compliance with local,
state, and federal standards will be made. Planned development with
adherence to floodplain/wetland conservation ordinances should, in the
long run, benefit the floodplain.
