WHEREAS, on December 30, 2020, Tommy McElroy executed a Deed of Trust to
Charles B. Magee, Jr., Trustee for the benefit of the Bank of Franklin,
a State chartered bank of Franklin County, Mississippi, Beneficiary, to
secure an indebtedness therein specifically mentioned and set forth and
covering the real estate in Franklin County, Mississippi, described
below, which Deed of Trust is recorded in Deed Book 2023, Page 1166 of
the land records of Franklin County, Mississippi; and,
WHEREAS, on February 2, 2024, the Beneficiary, Bank of Franklin, duly
and legally substituted Ashley A. Johnson as Trustee in the above
referenced Deed of Trust dated December 30, 2020, by Substitution of
Trustee recorded in Deed Book 2024, Pages 899-901, of the records on
file in the office of the Chancery Clerk of Franklin County,
Mississippi, which substitution was actually spread upon said record
prior to the first date of publication of this notice; and,
WHEREAS, default has occurred in the payment of the indebtedness secured
by said Deed of Trust, and default has occurred in the performance of
the covenants and obligations contained in said Deed of Trust and in the
promissory notes secured thereby, and said Beneficiary, as holder and

NOTICE FOR EARLY PUBLIC REVIEW OF A PROPOSAL TO SUPPORT ACTIVITY IN THE
100-YEAR FLOODPLAIN OR WETLAND
To: All Interested Agencies, Groups, and Individuals
This is to give notice that Bude, Mississippi is proposing to expend
federal funds in a 100-Year Floodplain or Wetlands. The subject funds
are Community Development Block Grant administered by the Mississippi
Development Authority:
This notice is required by Section 2(a)(4) of Executive Order 11988 for
Floodplain Management and by Section 2(b) of Executive Order 11990 for
the Protection of Wetlands, and is implemented by HUD Regulations found
at 24 CFR 55.20(b) for the HUD action that is within and/or affects a
floodplain or wetland.
The Town of Bude is proposing to undertake the following activities in
the area:
PROJECT DESCRIPTION: The rehabilitation of two lift stations, the
replacement of a lift station and equatic vegetation removal in the
lagoon. A portion of the proposed project may impact less than one
hundred (100) acres.
The purpose of this notice is to give an early opportunity for
interested agencies, persons or groups to comment on the proposed
action. The Town of Bude will consider any feasible alternatives or
adjustments to the anticipated project which might minimize any
potential adverse effects upon the floodplain/wetland as a result of the
project.
This notice with a request for comment was mailed to the regional office
of the Federal Emergency Management Agency and the state office of
Environmental Protection.
Additional information concerning this project is available for public
review and copying, upon request, at: Town of Bude, 125 Railroad Avenue,
Bude, MS. Any comments relative to this proposed expenditure of federal
funds in an area identified as a flood hazard/wetland area should be

with auxiliary hydraulics and standard bucket which includes an operator
station which includes a radio and analogue display; 19,401 lb Operating

provided for continuous operation during one full shift. Unit shall be
